HC stays arrest of former MLAs
Chandigarh, August30 2018:  The Punjab and Haryana High Court on Thursday stayed the arrest of former MLAs in the alleged cash for-CLU scam. The former MLAs include Vinod Bhayana, Naresh Selwal, Jarnail Singh and Ram Niwas Ghorela. Haryana Lokayukta had recommended lodging of FIR against them, but the High Court, in December 2015, had stayed the operation of the orders.

Taking up an appeal, a Division Bench had, however, stayed the operations of the interim order. The matter has since then gone up to the Supreme Court. In one of the applications now filed against the state and other respondents, Bhayana through counsel R Kartikeya and Arjun Pratap Atma Ram were seeking directions for restoring interim protection granted vide order dated December 24, 2015.

The Bench of Justice Jaswant Singh was told that the petitioner was filing the application for restoration of the interim order during the pendency of a petition as the respondents-state, armed with an ex parte order, got an FIR lodged against the petitioner and were unnecessarily harassing him. The petitioner was also not given a copy of the FIR, despite formal requests.

Taking up the facts from Vinod Bhayana’s petition, the High Court in December 2015, had observed a complaint dated January 28, 2014, was filed against the petitioner before the Lokayukta. At that time, the petitioner was Chief Parliamentary Secretary. The complaint contained allegations of official position’s abuse to obtain undue gain. The allegations were sought to be substantiated by a video. The transcript, the video and a pen drive were annexed along with the complaint. The Lokayukta submitted his report with recommendations after completing the inquiry.
